Rubbish Collection Pimlico Service Terms and Conditions
1. Introduction
These Terms and Conditions govern the provision of waste and rubbish collection services by Rubbish Collection Pimlico to you as a customer. By booking or using any of our rubbish removal, waste collection, or related services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
If you do not agree with any part of these Terms and Conditions, you should not proceed with a booking or use our services. We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will apply to services booked after the updated version is published or notified to you.
2. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, company, or organisation requesting or paying for our services.
Services means any rubbish collection, waste removal, clearance, loading, transportation, or disposal service provided by us.
Waste means the items, materials, and rubbish you present for collection, including household, commercial, garden, and bulky waste, subject to our restrictions.
Prohibited Waste means items we are not permitted or not prepared to collect or handle, including but not limited to hazardous, toxic, medical, clinical, explosive, or radioactive materials, asbestos, gas cylinders, and certain electrical items.
Booking means a confirmed request for services placed by you and accepted by us via phone, email, or online form.
3. Scope of Services
We provide scheduled or one-off rubbish collection services, including the loading and removal of waste from residential, commercial, or other premises in and around Pimlico and adjoining areas, subject to capacity and availability.
The exact scope of each service, including the estimated load size, number of items, vehicle size, labour, and timing, will be agreed at the time of booking. Additional services, such as extra labour, additional loads, or special handling, may be provided at our discretion and may incur extra charges.
We will take reasonable care to conduct collections efficiently and with minimal disruption; however, we do not guarantee that all waste will be removed if it exceeds the agreed load or if it includes Prohibited Waste.
4. Booking Process
You may request a rubbish collection by contacting us via phone, email, or any booking system we may provide. When you make a booking, you must provide accurate details, including the collection address, type and approximate quantity of waste, access conditions, and preferred dates and times.
Any quotation or estimate given before the collection is based on the information you supply. If on arrival the quantity, weight, or nature of the waste differs significantly from what you described, or if access is more difficult than disclosed, we may revise the price, adjust the service, or refuse to proceed.
Your booking is only confirmed when we accept it and provide you with a booking reference, confirmation message, or verbal confirmation. We reserve the right to refuse any booking at our discretion.
5. Access and Customer Obligations
You must ensure that our staff and vehicles have safe, lawful, and reasonable access to the collection point at the agreed time. This includes providing any necessary parking permissions, entry codes, or instructions to reach the waste safely.
You must ensure that the waste to be collected is clearly separated from items you wish to keep, and that it is accessible without the need for structural alterations, dismantling of fixtures, or removal of obstacles not previously agreed.
You are responsible for obtaining any third-party consents that may be required for us to access shared areas, private roads, or restricted spaces. If we are unable to carry out the service due to insufficient access or permissions, this may be treated as a late cancellation, and charges may apply.
6. Pricing and Quotations
All prices for rubbish collection services are stated in pounds sterling and, unless expressly stated otherwise, are exclusive of any applicable taxes. We may provide you with a guide price based on estimated volume, weight, or item count, and then confirm or adjust the price on arrival once we have inspected the waste.
We reserve the right to charge additional fees for heavy or dense loads, difficult access, extra labour beyond normal expectations, or any waiting time caused by your delay in providing access or instructions. Where possible, we will inform you of any additional charges before performing the extra work.
Verbal or written quotations are not binding if the information you provided was inaccurate or incomplete. We may withdraw or amend a quotation at any time before accepting a booking.
7. Payment Terms
Payment for the services is due on or immediately after completion of the collection, unless we have agreed alternative terms in writing. We accept payment by cash, card, bank transfer, or other methods we may offer from time to time.
For commercial customers or regular scheduled services, we may agree to issue invoices with specified payment terms. If an invoice is not paid by the due date, we reserve the right to charge interest on overdue sums, recover reasonable collection costs, and suspend further services until the account is settled.
Ownership of the collected waste transfers to us only upon full payment of all sums due for the relevant collection. Until payment is made, we may at our discretion decline to remove the waste or may remove it under a retention of title arrangement, without prejudice to our other rights.
8. Cancellations and Rescheduling
You may cancel or reschedule a booking by providing us with notice. Where possible, we ask for at least 24 hours notice prior to the scheduled collection time. Cancellations or changes made with less notice may incur a cancellation or call-out fee to cover our administrative and travel costs.
If you are not present at the agreed time and place of collection, or if we cannot access the premises or waste due to reasons within your control, we may treat this as a late cancellation and reserve the right to charge a fee equivalent to all or part of the quoted service price.
We may cancel or postpone a collection due to events beyond our reasonable control, including severe weather, traffic disruption, vehicle breakdown, staff illness, or safety concerns. In these circumstances, we will seek to rearrange the service with you at a mutually convenient time, and we will not be liable for any loss or inconvenience arising from such delay or cancellation.
9. Waste Types and Regulations
We operate in compliance with applicable UK waste management and environmental regulations. All waste we collect is transported and disposed of at authorised facilities using lawful and responsible methods. We may issue or maintain records relating to waste transfer as required by law.
You are responsible for ensuring that the waste you present is accurately described and does not contain Prohibited Waste. If hazardous or restricted materials are discovered within your waste, we may refuse to remove them, charge an additional fee for safe handling, or return the waste to you if it has already been loaded, where lawful and practicable.
You must not conceal hazardous or prohibited items within general rubbish or mix them with other waste streams. Failure to comply may result in additional charges, termination of the service, and possible reporting to the relevant authorities if required.
10. Customer Representations
By using our waste collection services, you confirm that you are either the owner of the waste or have the authority of the owner to arrange for its removal. You warrant that no third party has any claim or interest that would prevent us from lawfully taking possession of and disposing of the waste.
You also represent that all information provided to us is accurate and complete to the best of your knowledge. If your information is found to be misleading or materially inaccurate, we may adjust our charges, refuse the service, or seek compensation for any losses or liabilities we incur as a result.
11. Liability and Limitations
We will exercise reasonable skill and care in providing rubbish collection services. However, our liability to you is subject to the limitations in this section.
We will not be liable for any indirect, consequential, or economic losses you may suffer, including loss of profit, business interruption, loss of opportunity, or loss of goodwill, arising out of or in connection with our services or these Terms and Conditions.
We accept no liability for pre-existing damage to your property or premises, or for damage arising from inherent defects, poor construction, or unsafe conditions. You must inform us before the collection if there are any particular risks or fragile areas we should be aware of.
Where damage is caused directly by our negligence, our liability will be limited to the reasonable cost of repair or replacement, subject to a maximum aggregate amount equal to the total price paid or payable for the specific collection giving rise to the claim, unless otherwise required by law.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, or for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded by law.
12. Insurance
We maintain appropriate insurance cover for our waste collection operations, including public liability insurance within reasonable industry standards. This insurance is intended to provide a level of protection in the event of accidental damage or loss caused by our negligence.
It remains your responsibility to ensure that you have adequate insurance in place to cover your own property and any potential losses not covered by our policy or by law.
13. Complaints and Dispute Resolution
If you are unhappy with any aspect of our services, you should contact us as soon as possible with full details of your concern, including the date of service and any supporting information. We will review your complaint, investigate if needed, and respond within a reasonable timeframe.
We aim to resolve disputes amicably. If a resolution cannot be reached through our internal process, either party may consider independent advice or other dispute resolution options. These Terms and Conditions do not restrict your statutory rights as a consumer, where applicable.
14. Data Protection and Privacy
We collect and process personal data such as your contact details, address, and service information for the purposes of administering bookings, providing services, processing payments, and managing our relationship with you.
We will handle your personal information in accordance with applicable data protection laws and will only share it with third parties where necessary to deliver our services, comply with legal obligations, or where you have given your consent.
15. Force Majeure
We will not be responsible for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay is caused by events beyond our reasonable control. These events may include but are not limited to extreme weather, fire, flood, industrial disputes, road closures, acts of government, or other unforeseen circumstances.
Where a force majeure event occurs, we will seek to minimise its impact and resume normal service as soon as reasonably practicable.
16. Severability
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision will be severed from the remaining provisions, which will continue in full force and effect.
17. Entire Agreement
These Terms and Conditions, together with any specific details confirmed in your booking, constitute the entire agreement between you and Rubbish Collection Pimlico regarding the provision of our waste collection services. They supersede any prior understandings, arrangements, or representations, whether oral or written.
18. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our rubbish collection services, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, without prejudice to any mandatory rights you may have as a consumer under applicable law.
